An Act of The Maya-We Nation

Preamble

WHEREAS, the Maya-We Nation is a sovereign Indigenous nation committed to justice, peace, and global cooperation;

WHEREAS, the principles of Customary International Law (CIL) reflect the universal norms that govern relations between sovereign nations and peoples;

WHEREAS, the Maya-We Nation seeks to formalize and integrate these principles into its governance framework to ensure alignment with global legal standards and strengthen its commitment to upholding the rights and responsibilities of nations;

THEREFORE, be it enacted by the governing authority of the Maya-We Nation, under the leadership of Chief Winter Hawk (Cacique Samael Ojeda Mercado), that the following provisions shall constitute the formal codification of Customary International Law within the nation’s legal structure:

Article I: Title and Purpose

1. Title: This Act shall be known as The Customary International Law Codification Act of the Maya-We Nation.
2. Purpose: The purpose of this Act is to formally adopt and codify the principles of Customary International Law into the legal and governance framework of the Maya-We Nation, making these principles binding and enforceable internally.

Article II: Scope of Application

1. Recognition of Customary International Law: The Maya-We Nation formally adopts the principles of Customary International Law as recognized by the international community, including but not limited to:

  • The inherent right of all peoples to self-determination.

  • Respect for sovereignty and territorial integrity.

  • The obligation to settle disputes peacefully.

  • Non-interference in the internal affairs of other nations.

  • Fundamental human rights as recognized under international law.

2. Integration into Governance Framework: These principles shall serve as a guiding framework for the Maya-We Nation’s governance, diplomacy, legal system, and interaction with other nations and entities.

3. Supremacy of This Act: In cases where any internal policy or law conflicts with the principles of Customary International Law, this Act shall take precedence, ensuring alignment with these universal norms.

Article III: Obligations and Enforcement

1. Binding Nature: This Act binds all governing bodies, agencies, representatives, and citizens of the Maya-We Nation to uphold the principles of Customary International Law in all actions, policies, and interactions.

2. Enforcement Mechanism: The Maya-We Nation shall establish a council or tribunal to oversee and ensure compliance with this Act. This body shall have the authority to:

  • Review policies and decisions to ensure consistency with Customary International Law.

  • Address disputes or violations of these principles within the governance structure.

  • Provide recommendations to amend or revise internal laws for greater alignment.

3. Diplomatic Representation: The Maya-We Nation’s ambassadors, diplomats, and representatives shall be guided by this Act in all international engagements, ensuring adherence to the principles of Customary International Law.

Article IV: Affirmation of Self-Determination

1. Sovereignty: The Maya-We Nation reaffirms its inherent right to self-determination, as recognized under international law and enshrined in the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP).
2. Independence: This Act does not diminish the sovereign authority of the Maya-We Nation but rather strengthens its position by aligning with globally recognized norms.

Article V: Declaration of Good Faith and Cooperation

1. Commitment to Peace: The Maya-We Nation pledges to engage with all nations, peoples, and entities in good faith, promoting peaceful coexistence and cooperation.
2. Partnership Building: This Act serves as an open invitation to other nations, governments, and organizations to engage with the Maya-We Nation as a responsible and principled member of the global community.

Article VI: Amendments and Revisions

1. Authority to Amend: This Act may be amended by the governing body of the Maya-We Nation to reflect the evolving nature of international law and its application.
2. Periodic Review: The principles codified in this Act shall be reviewed periodically to ensure continued alignment with global standards and the best interests of the Maya-We Nation.

Article VII: Effective Date and Ratification

1. Effective Date: This Act shall take effect immediately upon its ratification by the governing authority of the Maya-We Nation.
2. Ratification: This Act is ratified and enacted under the full authority of Chief Winter Hawk (Cacique Samael Ojeda Mercado) as the recognized leader of the Maya-We Nation.
